Legislative Update: The Taxpayer Protection Act

On July 15th, Governor Ayotte finally signed into law HB1300, which will significantly expand local control.

HB1300 requires that November 2026 and 2028 ballots include a question on whether voters want to limit the school property tax growth under RSA 32:5-i. A difficult to achieve 60% supermajority is required for the measure to pass. 

If the measure passes, the School Board would be limited in increasing property taxes no more than inflation, (Northeast Consumer Price Index). Total property taxes would also be allowed to increase to account for any net new taxable property growth (new buildings, etc.).

The other applicable legal requirement is that administrative budgets couldn’t exceed 6% of the overall school budgets.

Those restrictions would apply to the 2027-28 and 2028-29 school years for a 2026 adoption, and to the 2029-30 and 2030-31 school budgets for a 2028 adoption.

This legislation does not mandate a cap - it merely requires the question be asked of the voters in every school district, so they can make their own decisions. 

Between the property tax cap and the administrative budget restriction, this measure should be effective in slowing down the growth of school budgets in the communities that adopt it.

Just like they opposed parent rights, and any attempt to lower energy prices, or lower taxes, Democrats also opposed this legislation - they don’t want you to have a chance to cast a meaningful vote on the school budget.

This March, all you got to vote on was a 0.36% difference between the proposed budget of $72,503,095 and a default budget of $72,239,822). 

Does local control work when you are told that you owe $100 if you say yes or $99.64 if you say no?

Local control only works when voters are given meaningful choices - HB1300 will do that this November.
